Knox and former boyfriend, Raffaele Sollecito were both released after an appeal, which lasted over four months. At the heart of this appeal was DNA evidence and the character of Amanda Knox.
Investigating Police scientists disputed that a knife, found at Sollecito’s home, had minuscule traces of Kercher’s DNA on the blade and Amanda Knox’s DNA on the handle. They also testified that a bra clasp found in Kercher’s room and belonging to Kercher, had Sollecito’s genetic code on it.
The experts appointed by the court, questioned police handling of the evidence, suggesting authorities’ negligence could make the DNA results unreliable and should make them inadmissible in court.
According to the “re-trial” investigative reports, the crime was entirely the handiwork of drifter Rudy Guede, who was convicted separately and is serving 16 years. Splattered all over the crime scene, Guede’s DNA fostered his guilt…to paraphrase the defense. This may have been sufficient casting of doubt for the jury to set Knox and Sollecito free.
Richard Allen Greene had this to say in his report for CNN, “Defense lawyer Luciano Ghirga reminded the jury repeatedly Monday morning that the prosecution needed to prove its case “beyond a reasonable doubt” — a standard he made a point of saying was rooted in Italian law and was not imported from America, in a nod to the nationalistic tensions that have sometimes seemed to underpin this case.”
The jury must have had sufficient cause and dubiety to overturn a verdict rendered by eight of their colleagues less than two years ago. So, Knox and Sollecito were either the victims of a miscarriage of justice then, or Meredith Kercher is now.
It has been nearly four years since 21 year old, Meredith Kercher’s death, and the irrefutable evidence about whether Knox and Sollecito were involved remains incredibly elusive.
The following is a summary of the original article written concerning the Amanda Knox case:
(Reprint from December 9th, 2009) This has been a harrowing week for the families involved in the trial of Amanda Knox. A miscarriage of justice or were the cartwheels and splits at the police station inappropriate behavior of a calculated killer. The murder of Meredith Kercher, a 21 year old British student who was part of a university exchange program to Italy, has created an international debate. On November 2nd, 2007, her body was discovered by Italian police at the cottage that she shared with other students in Perugia.
Three suspects were arrested on November 6, 2007: Patrick Diya Lumumba, the owner of Le Chic, the bar where Knox occasionally worked; Amanda Marie Knox, 20, a U of W student from Seattle, Washington, USA, attending the University for Foreigners in Perugia; and Raffaele Sollecito, 23, an Engineering student at the University of Perugia, from Giovinazzo, Bari. Amanda Knox and Raffaele Sollecito had only known each other for a few days when Kercher was murdered. Sollecito is from an affluent family, the son of a urologist from Bari.
Patrick Diya Lumumba, was later released and exonerated. Mr. Lumumba was very well liked in Perugia, and was arrested after reportedly being implicated by Knox in Kercher’s murder. Unfairly detained for two weeks, he was recently awarded approximately $12,000.00 for unjust imprisonment.
For his suspected involvement in the Kercher killing, Italian authorities issued an arrest warrant for Rudy Hermann Guede, 20, due to the DNA and fingerprint evidence found on the victim’s body. They arrested him on November 20, 2007 on a train near Wiesbaden, Germany, where he was caught riding without a ticket. Guede initially fled the country the night of the murder.
As a preacher’s kid, I spent about a month of my childhood summer’s hanging out at Wheatstate Campground, an Assemblies of God campground, just 20 minutes East of Wichita, Kansas. While mom and dad worked as counselors and kitchen help for the various camps, I roamed, like Opie Taylor, from Santa Fe Lake to the back side of the tabernacle to the tetherball pole to the pop stand, and every where in between. I did enjoy my adventures, but they were lonely…until I met a very large, equally lonely Golden Retriever mix near the miniature golf course. He followed me everywhere. When I went inside a building, he’d wait for me until I returned. He was my new best friend. I rolled around in the grass and wrestled with this gentle giant until the cows came home, or at least until dark. Mom was calling me to come clean up before bed and by this time, I was pretty exhausted so I didn’t argue. For some reason, mom was having trouble running a comb through my hair. It seemed I brought some friends home from my day of frollicking with my new friend. The Golden Retriever stray had ticks, a lot of them, and now, so did I. I had a head full of more than a half dozen, blood sucking, pea sized ticks. I had no idea that just by spending the day with this dog, these parasitic arachnids would attach themselves and begin feeding relentlessly on my blood. Considered a proverb, the saying, “If you lie down with dogs, you will rise with fleas.” was certainly applicable, only with a friendly exchange of the ticks instead of fleas.
I can’t imagine the anguish of losing a child, especially if it could have been preventable, however that may have been. Meredith’s parents won’t be communicating with their daughter ever again. This senseless deed was the conclusion of a young girls life that had only just begun. To them, every thing else in this article is just noise. I can only imagine, Meredith, as a young girl, playing in her yard with a big dog. The memories that her family cherishes. The Bible is profoundly clear when speaking of good and evil. An absolute standard to which all of us should live by. First Corinthians 15:33 says, “Bad company corrupts good morals.”, more specifically in another translation, “Stop being deceived: “Wicked friends lead to evil ends!”. Only God knows where these young lives began to derail.
On October 28, 2008, Guede was convicted in a “fast-track” trial of conspiracy to murder Kercher. He was subsequently convicted of murder and sentenced to 30 years in an Italian prison. On December 4, 2009, after almost a year long trial, Amanda Knox and her former boyfriend Raffaele Sollecito, were found guilty of murder, sexual violence and other charges. Amanda Knox, now 22, was sentenced to 26 years in prison, while Raffaele Sollecito, now 25, was sentenced to 25 years. Knox’s family continues to staunchly defend her innocence. They have informed the media that they intend to appeal immediately, and that some of her family are planning to move to Italy to be close to her during the appeal process. Sollecito is also expected to appeal.
US Senator Maria Cantwell’s has made a statement on the Amanda Knox Guilty Verdict;
“I am saddened by the verdict and I have serious questions about the Italian justice system and whether anti-Americanism tainted this trial. The prosecution did not present enough evidence for an impartial jury to conclude beyond a reasonable doubt that Ms. Knox was guilty. Italian jurors were not sequestered and were allowed to view highly negative news coverage about Ms. Knox. Other flaws in the Italian justice system on display in this case included the harsh treatment of Ms. Knox following her arrest; negligent handling of evidence by investigators; and pending charges of misconduct against one of the prosecutors stemming from another murder trial.”
UPDATE: Amanda Knox is now free, released from the Perugian jail and sent home to enjoy her newly found freedom! Right, wrong or indifferent, I’m sure after enduring such a trial, we would all be quoting the great Martin Luther King, “Free at last, free at last, thank God Almighty, we’re free at last!”.
