The story is as surprising as it is depraved—if it is true. A Queens mother is claiming that her son, who is now 6, was sexually assaulted in the boy’s room of the school he attended while he was still in kindergarten. And the assailants, she further maintains, were the child’s 5-year-old peers!
The New York Daily News reports that Yenny Valero, 31, of Astoria, is suing the city for $10 million for failing to prevent the attack, which allegedly occurred in Public School 112. She is quoted as saying, “My son still can’t sleep and he is very anxious, even though he is going to therapy.”
Valero, who arranged to have the child transferred to another school following the incident, claims that four fellow kindergartners held the child down, removed his pants, and violated him by inserting a finger into his anus.
According to a suit she filed in Queens Supreme Court, her son sustained permanent physical and psychological injuries from the assault.
The obstacle that the plaintiff faces going forward is proving that the attack occurred. Valero’s lawyer Julio Portilla insists the incident happened, even though neither the police nor school officials were able to substantiate the boy’s claims.
Portilla is quoted as saying “The school failed in its duty and now they are trying to sweep it under the rug.”
